Procedures

In order to enforce the Rules of Terra Cotta Gardens Ltd. and non-compliance of such, the Board of Directors follows the procedures listed below AS WARRANTED BY THE CIRCUMSTANCES AND IN SOME INSTANCES MANNER OF ENFORCEMENT IS BASED ON A MAJORITY VOTE OF THE DIRECTORS.

  1. A verbal warning is issued regarding the offence.
  2. If same offence is repeated, a written warning is issued.
  3. If compliance is still not obtained, the further steps below will be taken by the
    Board of Directors in order to enforce the Rules as listed below:

Seasonals Campers will receive a hand-delivered letter stating any of the below:

  1. May have Gate Card cancelled and have to leave vehicle at the gate and walk in for stated length of time.
  2. May have Gate Card cancelled and be banned from entering Terra Cotta Gardens Ltd. for stated length of time.
  3. Upon receiving a 24-hour notice, may have Gate Card cancelled, be banned from entering Terra Cotta Gardens Ltd. and have hydro to their trailer turned off for stated length of time.
  4. Be permanently evicted from Terra Cotta Gardens Ltd. and never be allowed to return to Terra Cotta Gardens Ltd., even as a Visitor to another camper.
  5. Any Seasonal granting access or bringing in a banned camper may be faced with the procedures listed above including also being permanently banned from Terra Cotta Gardens Ltd.

  2. May have Gate Card cancelled and be banned from entering Terra Cottta Gardens Ltd. for stated length of time.
  3. Upon receiving a 24-hour notice, may have Gate Card cancelled, be banned from entering Terra Cotta Gardens Ltd. and have hydro to their trailer turned off for stated length of time.
  4. A Shareholder can be banned from Terra Cotta Gardens Ltd. for a period of time as determined by the Board of Directors based on the severity and/or circumstances of the offence.
  5. A shareholder can be served with a “Notice of Trespass” for a period of time to be determined by the Board of Directors.
  6. Any Shareholder granting access to a banned camper or bringing in a banned camper may also be banned from entering Terra Cotta Gardens Ltd. for an amount of time to be determined by the Board of Directors.

Hydro Bills

Payment in full is due within two(2) weeks of receiving your bill. After two(2) weeks the cost increases by amount stated on your bill. If not paid with four(4) weeks of the bill being issued, your hydro will be shut off. The shut off date is written on your bill. A fee will be added to the bill in order to have it turned back on.

Camping / Park Fees

Seasonal Campers

A third of your down payment is due Labour Day weekend. Any camper who has not paid by the Holiday Monday, will be assumed to not be camping with us next year and will be expected to have their trailer and any other belongings including sheds, decks and screen rooms removed from Terra Cotta Gardens Ltd. by Thanksgiving Monday.

The balance of your camping fee will be due on the May 2-4 weekend. If your fees are not paid in full by the Holiday Monday of the May long weekend, you will not be allowed to use your campsite or any portion of our Park until fees are paid in full.

If you are in arrears with either payment, a $10.00 fee will be added to your bill each week ending on Sunday at 6:00 pm.

After a period of one month, the Board will make a decision on whether or ask you to remove your trailer and all other accessories, building/decks/sheds/belongings from the park know as Terra Cotta Gardens Ltd.

Shareholders

Half of your maintenance fee is due on or before November 1st.

The balance of your maintenance fees is due by May 1st. If you are in arrears after 30 days with either payment, a late fee of $50.00 will be added and $25.00 for each additional month.

Any Shareholder who is in arrears with their maintenance fee after sixty(60) days from Invoice date and more than twice in the past five(5) years will have their hydro and water shut off until they pay their fees in full. Any Gate Cards issued for their site will also be cancelled.

Any Shareholder who is in arrears will not be allowed to attend the Shareholders meetings or be represented by proxy or be able to run for office.

The Board will have the power to invoke “The Trespass of Property Act” on any Shareholder who is in arrears for thirty(30) days, until all monies are paid in full.

Visitor Fees

All Shareholders and Seasonal campers will be charged $75.00 per year.

Park Improvement Fee

All Shareholders and Seasonals campers will be charged $100.00 per year.
